Amendment To Applicability Under The Employees State Insurance Act,1948 For Maharashtra
The Government of Maharashtra vide notification No.ESIC 2015/C.R. 150/RAKAVI-2 has approved the notification dated 10th September 2020 towards amendments under The Employees State Insurance Act,1948. As per the amendment, the act shall extend to Shops, Hotels, Restaurants, Road Motor Transport Establishments, Cinema including preview theatres, Newspaper establishment as defined in Section 2 of the Working Journalists (Condition of Services) and Miscellaneous Provision Act, 1995, wherein ten or more person are employed or were employed on any day of the preceding twelve months. Automatic Online Renewal Of License Under The Factories Act In Rajasthan
The Government of Rajasthan vide circular no:2019/PS/00580/536 dated 29th September 2020 in order to enhance Ease of Doing Business in the State, has notified that henceforth, Renewal of License granted under the Factories Act 1948, in accordance with Section 6 and Rule 7 (Renewal of License) of the Rajasthan Factories Rule, 1951 shall be in a transparent, non-discretionary, online and Automatic renewal manner subject to the online deposit of renewal fee through the existing portal of the department (http://rajfab.nic.in). Further, department vide. a banner on the portal states the following:- "Auto-Renewal has been started for renewal of factory license under The Factories Act 1948. Please apply for Factory Renewal through Auto-Renewal Option only''. Hence, Employers having their factories in the State of Rajasthan registered under the Act may note and avail of the mentioned facility for online auto-renewal of license and comply accordingly
Tamil Nadu
The Governor of Tamil Nadu has issued an order to make the Payment of Bonus Act, 1965 (Central Act 21 of 1965) applicable to the establishments within the meaning of clause (j) of sub-section (1) of Section 2 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 (Central Act 27 of 1996) in which less than twenty workers and not less than ten workers are employed or were employed on any day during the accounting year 2019
Karnataka
Implementation Of Auto-Renewal System Under Ease Of Doing Business In Karnataka
The Government of Karnataka, vide order no. LD 241 LET 2020, in order to enhance Ease of Doing Business in the State, has ordered that henceforth, renewal procedures for Certificates / Registration / Licenses for establishments shall be in an auto-renewal system upon prescribed online payment of fees under the following acts:- (1) Registration under the Shops and Commercial Establishments Act, 1961 (2) License under the Contract Labour (Regulation and Abolition) Act 1970 (3) License under the Inter-State Migrant Workmen (Regulation of Employment & Conditions of Service) Act, 1979 (4) License under the Factories Act, 1948. Karnataka
The Government of Karnataka vide circular No.LGL-2/Others/CR-24/2020-2021 has informed that if OHC/Ambulance Rooms that are that are maintained by the managements in their factories are also registered under KPME Act and undergo applicable inspections, it will indirectly promote efficient management of the workers health at the health centers. Pursuant to the circular, the Department has directed its field officers to initiate action to advise factory managements with OHC/Ambulance room falling under this jurisdiction to register under The Karnataka Private Medical Establishments Act 2007 (KPME Act) in consultation with District Health and Family Welfare Departments. The field officers have also been directed to provide details of factories registered under the KPME Act to the Authority. Therefore, Employers having their factories in the State of Karnataka and who are mandatorily providing Occupational Health Centres/Ambulance in accordance with Rules 88 and 99 of the Karnataka Factories Rules, 1969 respectively are advised to make note of the above and comply accordingly. Punjab
The Factories (Punjab Amendment) Ordinance, 2020
Governor of Punjab vide notification No. 13-Leg./2020 has promulgated The Factories (Punjab Amendment) Ordinance, 2020. As per the notification, the government has increased the threshold limit for applicability to the Factories Act, 1948 from ten or more workers to twenty or more workers for factories operating with the aid of power and from twenty or more workers to forty or more workers for factories operating without the aid of power. The notification also amends the number of hours allowed to work overtime in any quarter from seventy-five hours to one hundred and fifteen hours. Please refer to the notification for more details
Jharkhand
The Jharkhand Tax On Professions, Traders, Calling And Employment (Amendment) Rules, 2020
Government of Jharkhand vide notification no. S.O. No. 79 has amended The Jharkhand State Tax On Professions, Trades, Callings, And Employments Rules, 2012. As per the Amendment (a) Under rule 3 which deals with the grant of certificate of registration and enrolment in which very assessee (other than government servant employer) having a place of work within the jurisdiction of registering authorities shall obtain a certificate of registration and or enrolment; shall make a true, correct and complete application for registration and or enrolment to such registering authorities, separately in respect of his place of work within the jurisdiction of the respective circles, electronically in form JPT 01 along with necessary documents. (b) Under rule 5 if there is any change in the furnished application for registration and or enrolment in Form JPT 01, either at the time of obtaining the certificate for registration and or enrolment or as amended from time to time, the registered and or the enrolled person shall, within fifteen days of such change, submit an application for amendment electronically in Form JPT -01A along with necessary documents relating to such change. (c) Further under rule 18 if a registered assessee fails to pay tax by the due date, as required under the Act or the rules, interest at the rate of two percent of the tax payable shall be payable for every month of default or part thereof. Further Extension Of Time Limit To Deposit Labour Welfare Fund In Maharashtra
The Government of Maharashtra through the official website of Maharashtra Labour Welfare Board has published a notice on the webpage intimating further extension of the last date for payment of contribution to the Labour welfare fund till 30th September 2020.
